International Poetry Forum (collectively, “we”, “our” and/or “IPF”) has prepared this privacy policy (this “Privacy Policy”), to provide visitors to this website, with important information about the personal data we collect, use, transfer and/or process in the course of operating this IPF website (www.internationalpoetryfoum.org and all sub-domains) (the “Website”). This Privacy Policy is specific to the Website and does not apply to any other website, platform, dashboard, portal or application that we may currently provide.

In this Privacy Policy, you will find information about the types of personal data we collect regarding you as a visitor and/or user of our Website, how and why we process such personal data, with whom we may share such information, as well as how we protect your information.  Additionally, in this Privacy Policy, we describe the processes by which you may contact us in order to exercise your options to: (1) access, correct, restrict, or delete your personal data; (2) object to the use of certain aspects of your personal data; and (3) ask any questions you may have about our privacy practices.  Please take note as well of those practices described in this Privacy Policy specifically stated to be necessary and/or integral to the performance of our Website. Where specifically noted below, exercising your rights as described herein may affect your ability to continue to access or use our Website.

This Privacy Policy may be updated and/or otherwise revised periodically to reflect changes in our data use practices and/or policies.  We will post notices of all such changes on our applicable websites, platforms and/or materials and the “Effective Date” noted above will indicate when this Privacy Policy was most recently revised.  Except as may be otherwise required under applicable law, revisions to this Privacy Policy will be effective on the Effective Date noted without any other notice or approval by you.  In certain jurisdictions, applicable law may require additional processes and procedures, in which case, revisions to this Privacy Policy will not be effective until we have met our obligations accordingly.

2.     Personal Data & Special Categories of Data

For the purpose of operating the Websites, we receive the following types of personal information submitted by you and collected by us as described below (as further detailed below, “Personal Data”):

a.     Contact Information – We may collect your contact information, which may include your name or email address.

b.    Correspondence and Feedback – When you contact us or provide us with feedback, suggestions or to submit a complaint regarding the Website, we may collect personal information from you, such as your name and email address. 

c.     Payment Card Data – In order for you to donate on our Website, your donation will need to be processed online.  In order for us to process your donation you will be directed to our third-party payment processing vendor to process your payment.  In order to process your payment, our payment processor will need to collect certain payment information from you, including the name of the cardholder, the card number, expiration date, CVV and the zip code associated with the card.  Please see Section 5(b) below for more information.

d.    Traffic Data – In addition to the Personal Data that you voluntarily provide, we also collect certain traffic data from you that is automatically generated (“Traffic Data”).  This Traffic Data may include, without limitation, IP address, browsing history, unique device IDs and how you use the Website including clicks, internal links, pages visited, scrolling, searches, and timestamps. These types of information do not generally identify or relate to you as an individual, but we may associate these types of information with you as an individual.

e.     Children’s Data – We do not knowingly collect, maintain, or process Personal Information by anyone under the age of 13. To the extent IPF knowingly collects Personal Information of a minor in the context of one of the purposes mentioned in this Privacy Policy, we will only do so with the appropriate consent or as otherwise permitted under applicable laws.

3.     How We Obtain Personal Data

a.     Newsletter – you may choose to provide your email address to subscribe to receive news and information about upcoming events.

b.     Contact – if you reach out to us for support or with feedback, suggestions or complaints, we will collect your name, phone number and email address to provide you with appropriate assistance.

c.     Payment – in order for us to process any donations that you make through our Website you will be required to provide certain Personal Data, as described in Section 2 above.

4.     Data Use and Data Retention – We do not sell your Personal Data to third parties.  We do not share or use your Personal Data for purposes of behavioral or targeted advertising.  We use Personal Data that we receive hereunder only as necessary to provide you with access and use of our Website, subject always to your options to manage your Personal Data as set forth in Section 6 below:

a.     Website Use and Functionality – We use certain Personal Data in order to provide you with access to and use of the Website. You may refuse such permission, or subsequently opt-out by adjusting the browser settings; but you acknowledge that the Website may not function as intended if you do so.

b.    Support – When you contact us with inquiries, suggestions, feedback, complaints or for support we will use the Personal Data that you provide to us in order to appropriately respond to your requests and to assist you.

c.     Performance and Improvement – We monitor information on visitor activity within our system,  track the performance of the Website, detect trouble-shooting and overall improve the Website. 

d.    Compliance with Legal Obligations – In addition to the use and sharing of Personal Data for the purposes of providing access and use of our Website, we process Personal Data received hereunder to comply with our own legal and regulatory obligations.  For example, we may process personal information to comply with: record keeping requirements, reporting requirements, court order, law enforcement order, and other legal and/or regulatory requirements.

e.     Legitimate Interests – We may also use Personal Data collected hereunder in circumstances other than as expressly described above in connection with the services we provide; provided, however that any such additional processing may only occur when there is a legitimate interest to do so that is not overridden by your data protection rights as required by applicable law.  The types of processing/uses contemplated hereunder may include, without limitation, for our own administrative and business needs, audits and self-assessments for compliance with applicable laws, regulations, court order, law enforcement order, and applicable workplace policies, and for information technology purposes including without limitation trouble shooting, business continuity, disaster recover, data backup and recovery.

f.      Data Retention – We generally retain Personal Data for the periods specified in accordance with applicable law, regulation, and/or court order, and in our document retention/filing policies, currently set at seven years.  We may also retain Personal Data for longer periods where there is a reasonable basis for retaining such data, including without limitation in connection with the establishment, exercise or defense of legal claims.

5.       Onward Transfers – Data We Share With Others.  We will not sell, share, transfer, disclose, rent, use, or distribute Personal Data hereunder for purposes other than as set forth in this Privacy Policy, unless required by law or as expressly authorized by a data controller as described above.

a.     Third-Party Website Host – The Website is hosted by Squarespace. When you visit the Website, Squarespace collects information about your browser, network and device, web pages you visited prior to coming to the Website, web pages you view while on the Website, and your IP address. Squarespace may use the information collected for purposes of running the Website, and to protect and improve its platform and services. Currently, Squarespace analyzes the information in a de-personalized form.

b.     Third-Party Payment Processors – We use Stripe or PayPal to process the payment of any online donations that you place through our Website.  In order for Stripe or PayPal to process your payment you will be required to provide Stripe or PayPal with certain personal information, as described in Section 2(c) above.  We do not have access to payment card information that you provide to Stripe or PayPal.  Stripe, and PayPal process your Personal Data in accordance with their respective privacy policies located at:

c.     Social Media Link -  We may include social media features, such as a link to the IPF Instagram. If you choose to click such social media links, the applicable third-party social media operator may receive your personal information, including information about your browser, network and device, details about the web page or content you shared, and your IP address. Your interactions with these features are governed by the privacy policy of the company providing it.

d.     Exigent Circumstances – In addition to the disclosures set forth above, we will disclose Personal Data about you: (1) if we are required to do so by law or legal process, (2) to law enforcement authorities, judiciary or other government officials, (3) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss in connection with an investigation of suspected or actual illegal activity; or (4) if necessary to protect the vital interests of any person.

6.     Data Management – State consumer privacy laws may provide their residents with additional rights regarding use of their Personal Data.  According with our processing of Personal Data per this Privacy Policy, we provide you with the following options with respect to our use of your Personal Data.

You can contact us to exercise your options to opt-out of use of your Personal Data for targeted advertising (if any), delete your Personal Data, receive a copy of your Personal Data, or correct your Personal Data. We will work to honor your request and assist you with respect to such requests, where appropriate and in compliance with applicable law.

In order to meet our obligations under applicable law, we may take reasonable steps to verify your identity before responding to demands as set forth in this Section 6.

7.     Complaints, Concerns, Recourse – In the event you believe IPF has failed to protect your privacy or you have unresolved concerns about the use of your Personal Data, please immediately submit your concerns to us at: director@internationalpoetryforum.org.  Please provide details regarding your concerns and include full contact information so we can respond as quickly and completely as possible.

8.     Website Operations

a.     Cookies – The Website uses “cookies” which are small files or pieces of text that are downloaded and stored by your browser on your computer’s hard drive when you access a website.  We may use both persistent and session “cookies” to provide customer efficiencies such as automatic filing in standard information on return visits, track website interactions or for authentication purposes.

                                               i.     Necessary Cookies: Squarespace uses some necessary cookies so you can navigate and use key features on the Website, such as remembering out-out preferences and prevents URL redirect loops.

                                             ii.     Analytics and Performance Cookies: Squarespace uses analytics and performance cookies to collect information about how you interact with the Website as described in Section 9.

b.    Gallery – In the Gallery section of the Website, we provide links to the International Poetry Forum Digital Collections hosted by Carlow University. Your interactions with these features are governed by the privacy policy of Carlow University located at https://www.carlow.edu/policy-directory/.

9.     Analytics and Tracking – We may use functions of Squarespace Analytics, a web analytics service provided by Squarespace, Inc. Squarespace Analytics uses “cookies”  to help us analyze how our website visitors are directed to our websites, and how our users use and view our Website, including visitor behavior and time spent on our websites.  Any information generated by the cookie about your use of our Website (including your IP address and any particulars about your browser and configuration as reported by your browser) may be transmitted to and stored by Squarespace. 10.  Do Not Track - Some browsers have incorporated "Do Not Track" (DNT) features that can send a signal to the websites you visit indicating you do not wish to be tracked. Currently, Squarespace does not respond to DNT signals.

11.  Opt-Outs –

a.     Universal Opt-Out Signal – Certain browsers and browser extensions provide you the option of opting out of the sharing of your Personal Information for purposes of behavioral targeted advertising through an opt-out preference signal setting powered by such browsers and browser extensions. Because we do not share your Personal Information for purposes of behavioral targeted advertising, the behavior of the Website will not change based on such opt-out signals.  

b.     Email Opt-Out - If you no longer wish to receive our newsletter or other email communications from us, you may opt out of receiving these communications by following the “unsubscribe” instructions at the bottom of each email or by changing the settings in your account, as applicable.
